General Terms & Conditions 

Access to and use of Vitruvian Fine Art Studio’s physical premises and vitruvianstudio.com, including any studio classes, workshops, live streaming events, recordings, online courses, lessons, tutorials, membership communities and training material (‘the Service’), within the U.S. and internationally, is provided by Vitruvian Studio Partners (‘Vitruvian Fine Art Studio’, ‘we’, ‘us’ or ‘our’) on the following Terms and Conditions.

By using the Service you agree to be bound by these Terms and Conditions. If you do not agree to be bound by all of the following Terms and Conditions please do not register, enroll, access, use and/or contribute to the Service.

Any new features that augment or enhance the current Service, including the release of new content and products, shall be subject to the these Terms and Conditions. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at: vitruvianstudio.com/terms

Violation of any of the terms below will result in the termination of your Account and/or suspension from any class, workshop or course of study at Vitruvian Fine Art Studio in which you are enrolled. While we prohibit certain conduct and content in use of the Service, you understand and agree that Vitruvian Studio Partners cannot be responsible for the content included in the Service and you nonetheless may be exposed to content you find objectionable. You agree to use the Service at your own risk.

1. Use of the Service 

1. 1. You agree to use the Service only for lawful purposes.
   2. You agree to use the Service only for personal, non-commercial purposes.
   3. You agree that the Service is provided “as is” and without warranty.
   4. You agree that Vitruvian Studio Partners has no liability regarding the Service.
   5. You consent to release Vitruvian Studio Partners from liability based on claims between Users and generally.
   6. You agree to indemnify Vitruvian Studio Partners from claims due to your use or inability to use the Service.
   7. You must only use the Service in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the Service. Prohibited behavior includes harassing or causing distress or inconvenience to any person, communicating obscene or offensive content or disrupting the normal flow of dialogue within the Service.

2. Amendments 

1. 1. Vitruvian Studio Partners reserves the right to make change to these Terms and Conditions from time to time and so you should check these Terms and Conditions regularly. Your continued use of the Service will be deemed acceptance of the updated or amended Terms and Conditions. If you do not agree to the changes, you should cease using the Service.  
   2. If there is any conflict between these Terms and Conditions and specific local terms appearing elsewhere on the Service (including rules for online discussion) then the latter shall prevail.

3. Registration and Enrollment 

1. 1. In order to participate in and contribute to Vitruvian Fine Art Studio classes, workshops, live streaming events, online courses, and membership communities, you may be required to register or enroll with vitruvianstudio.com. Any personal information supplied to vitruvianstudio.com as part of this registration or enrollment process and/or any other interaction with vitruvianstudio.com will be collected, stored and used in accordance with Vitruvian Studio Partners’ Privacy Policy available here.  
   2. To register or enroll in the Service you must be over eighteen years of age unless you have the explicit permission of your parent or guardian.  
   3. You must ensure that the details provided by you upon registration or enrollment or at any time are correct and complete.
   4. You must inform us immediately of any changes to the information that you provided when enrolling by updating your personal details in order that we can communicate with you effectively.  
   5. All registrations and enrollments must include a personal email address that you access regularly so that administrative email can be sent to you. Accounts registered with someone else’s email address, or with temporary email addresses may be closed without notice. We may require users to re-validate their account if we believe they have been using an invalid email address.  
   6. You must keep your password and user name confidential and not disclose them or share them with anyone. If you know or suspect that someone else knows your password you should notify us by at [email protected] immediately.

4. Intellectual property

1. 1. All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in and on the Service and all content located on or available through the Service shall remain vested in Vitruvian Studio Partners.  
   2. You must not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use Vitruvian Fine Art Studio content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any Vitruvian Fine Art Studio content except for your own personal, non-commercial use. Any other use of Vitruvian Fine Art Studio content requires the prior written permission of Vitruvian Studio Partners.
   3. The names, images and logos identifying Vitruvian Fine Art Studio or third parties and their products and services are subject to copyright, design rights and trademarks of Vitruvian Studio Partners and/or third parties. Nothing contained in these Terms and Conditions shall be construed as conferring any license or right to use any trade mark, design right or copyright of Vitruvian Studio Partners or any other third party.

5. Availability of the Service 

1. 1. Although we aim to offer you the best service possible, we make no promise that the services available at Vitruvian Fine Art Studio will meet your requirements. We cannot guarantee that the Service will be fault-free. If a fault occurs with the Service you should report it to [email protected] and we will attempt to correct the fault as soon as we reasonably can.
   2. Your access to the Service may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Any physical premises used by Vitruvian Fine Art Studio may also be closed for major holidays or to accommodate illness of instructors or staff. In such cases, we will attempt to restore the Service as soon as we reasonably can.

6. Vitruvian Studio Partners’s right to suspend or cancel your registration or enrollment 

1. 1. We may suspend or cancel your registration or enrollment immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.  
   2. The suspension or cancellation of your registration and your right to use the Service shall not affect either party’s statutory rights or liabilities.

7. Disclaimers and limitation of liability 

1. 1. All content provided on or through the Service, including the information, names, images, pictures, logos and icons regarding or relating to Vitruvian Studio Partners, its products and services (or to third party products and services), is provided “As is” and on an “As available” basis. To the extent permitted by law, Vitruvian Studio Partners excludes all representations and warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. Vitruvian Studio Partners does not guarantee the timeliness, completeness or performance of any aspect of the service or any of its content. While we try to ensure that all content provided by Vitruvian Studio Partners is correct at the time of publication, no responsibility is accepted by or on behalf of Vitruvian Studio Partners for any errors, omissions or inaccurate content on the service.
   2. Neither Vitruvian Studio Partners nor any of its officers or employees shall be liable for any of the following losses or damages (whether such damage or losses were foreseen, foreseeable, known or otherwise): (a) physical or psychological injury (including death); (b) illness; (c) loss of property; (d) damage to property; (e) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity or anticipated savings; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of the service regardless of the form of action.

8. Miscellaneous 

1. 1. If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms and Conditions and the remaining Terms and Conditions shall survive and continue to be binding and enforceable.
   2. You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
   3. If you breach these Terms and Conditions and Vitruvian Studio Partners chooses to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
   4. Vitruvian Studio Partners shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.

Chicago Workshops Terms of Use

These terms relate to any paid-for, in-person workshop (“Chicago Workshop”), event, or course-of-study provided in a physical space (the “Chicago Workshops Service(s)”) and should be read in conjunction with our General Terms & Conditions above which are incorporated by reference and shall also apply save where they are inconsistent with these terms.  Upon registration or enrollment for any class, workshop, event, or course-of-study conducted in Vitruvian Fine Art Studio’s physical studio space, you are confirming that you understand and agree to the following Terms and Conditions. If you do not understand these Terms and Conditions or do not agree to them, do not register or enroll for a class or event.

1. Prices and Payment

1. 1. Payment in full is required to hold a place in any Chicago Workshop Service. Vitruvian Fine Art Studio does do not accept partial payments unless an option to pay a deposit is listed on the website for that specific Chicago Workshop Service. We do not offer payment plans. 
   2. Registration fees are for an individual student to attend a particular class within specific dates. Fees are non-transferable to another class, to different dates, or to another student. 
   3. All model fees are included in the price of a class, workshop or course-of-study. No additional model fees will be charged.
   4. We include in the price of any Chicago Workshop Service the provision of work space, easels and/or benches, and lighting for the use of enrolled students during scheduled class times. We will also provide subjects (still life objects, models, etc.), as deemed appropriate by Vitruvian Fine Art Studio instructors, for enrolled students to draw and paint.
   5. Art materials are not included in the price of our Chicago Workshop Services. Beyond the items listed above, students must provide their own tools and materials for class, as recommended by Vitruvian Fine Art Studio instructors.
   6. We include in the price of any Chicago Studio Service the provision of short-term storage to accommodate artwork in progress between scheduled class sessions. 
   7. Long-term storage of finished or unfinished artwork is not provided as part of our Chicago Workshop Services. You are expected to take your artwork with you when finished, or when your scheduled period of study with us has ended, unless you make specific arrangements with Vitruvian Fine Art Studio instructors. Absent such arrangements, all unclaimed artwork left behind – on easels or benches, or in storage racks – following the conclusion of a class or workshop will be discarded. We are not responsible for unclaimed artwork left behind at the studio. 
   8. Vitruvian Fine Art Studio does not provide storage for art materials between class sessions. Aside from artwork in progress, you must take all your belongings, including art materials (paint, pencils, brushes, etc.), with you at the end of each class session. We are not responsible for unclaimed art materials left behind at the teaching space.

2. Cancellations and refunds

Send notification of cancellations to [email protected] 

1. 1. Cancellations before the start date:
      Prior to the scheduled start date, you can cancel your registration for any class, workshop, event, or course-of-study for a full refund minus a $50 non-refundable registration fee.
   2. Cancellations after the start date: 
      For workshops that span multiple consecutive days, you can cancel your registration up to 11:59pm on the first day of the workshop for a 50% refund of the total tuition. This gives you the morning and/or afternoon workshop studio session(s), plus the rest of the day up until 11:59pm to notify us of your intent to cancel. No refunds will be given after that time under any circumstances.

3. Missed classes

Makeup sessions for missed classes are not available for our Chicago Workshops Service.

4. Miscellaneous

1. 1. Students are expected to arrive on site no more than 30 minutes prior to the scheduled class start time. The teaching space will be open and accessible to you 30 minutes prior to the scheduled class start time.
   2. Students are expected to leave the teaching space in a timely manner following the end of a class session. You’re welcome to continue working until the scheduled end time of a class, at which point you are expected to begin packing-up to leave. You are not permitted to continue working on your artwork after the scheduled end time of a class session.  
   3. The teaching space space is available only to enrolled students during scheduled class times. The teaching space is closed to all other individuals and at all other times. 
   4. Instructors are assigned to teach classes and workshops with Vitruvian Fine Art Studio at our sole discretion. Students are not permitted to choose their instructor.
   5. Vitruvian Fine Art Studio reserves the right to use images of students and student artwork for program publicity, with respect for the privacy of the individual.
   6. Vitruvian Fine Art Studio is not responsible for any lost or stolen articles at the teaching space.
   7. Vitruvian Fine Art Studio accepts no responsibility for any student loss associated with unrecoverable travel costs or reservations.

Online Studio Terms of Use

These terms relate to any paid-for online course, workshop, live-streaming class, group, membership community, event or course-of-study provided on our website at vitruvianstudio.com (the “Online Service(s)”) and should be read in conjunction with our General Terms & Conditions above which are incorporated here by reference and shall also apply save where they are inconsistent with these terms.  Upon registration or enrollment for any class, workshop, event, or course-of-study conducted in physical premises utilized by Vitruvian Fine Art Studio, you are confirming that you understand and agree to the following Terms and Conditions. If you do not understand these Terms and Conditions or do not agree to them, do not register or enroll for a course or event.

1. Prices and payment 

1. 1. The Online Studio Service will be made available to you immediately once your payment has been processed. There will be no contract of any kind between you and us unless and until you make authorized payment for the Online Studio Service. At any point up until then, we may decline to supply the Online Studio Service to you without giving any reason.
   2. Registration and membership fees are for an individual student to attend a particular class, or participate in a specific membership community, within specific dates. Fees are non-transferable to another course or membership community, or to another student. 
   3. The fee for the Online Studio Service is calculated and payable as listed on vitruvianstudio.com. We have no obligation to provide the Online Studio Service until the fee has been paid.
   4. Art materials are not included in the registration or membership fee. It is the responsibility of each enrolled student to purchase their own art materials. Materials Kits for some courses and classes are available for purchase at vitruvianstudio.com, but these are each an additional purchase and are not included in the registration or membership fee. A comprehensive list of required and suggested materials is included in the first module of each course, or first session of each live streaming class, along with suggestions for where to purchase said materials.

2. Recorded Course Access 

1. 1. Recorded course access is granted immediately upon successful completion of payment. A transaction receipt will be emailed to you upon successful completion of payment.
   2. Access to our Online Services is granted solely to the individual who made the purchase. Transferring or sharing of login details with others is strictly prohibited and will result in immediate suspension of your account.
   3. Once purchased, access to Recorded Courses does not expire and will remain accessible to enrolled student indefinitely or for as long as Vitruvian Fine Art Studio continues to conduct business and maintains vitruvianstudio.com.
   4. Any “Critique Extension” service (recorded, private critique videos by the instructor) associated with a Recorded Course must be redeemed by the student within one calendar year of purchase. Critique Extension services not redeemed by the student within one calendar year will be forfeit without refund.
   5. Vitruvian Studio Partners reserves the right to remove any student from any course without refund should that student violate these Terms and Conditions.
   6. Vitruvian Studio Partners warrants that it has the right to provide the Recorded Course Service and will use all reasonable skill and care in making the Recorded Course Service available to you and in ensuring its availability. Because of the nature of the internet, errors and omissions do occur and Vitruvian Studio Partners does not give any other warranties in respect of the Recorded Course Service.  
   7. If Vitruvian Studio Partners has reason to believe that there is likely to be a breach of security or misuse of the website, we may require you to change your password or we may suspend your account.
   8. Vitruvian Studio Partners reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts, or disrupts any of our services in any way.
   9. If you use multiple logins for the purpose of disrupting a community or annoying other users you may have action taken against all of your accounts.
   10. Vitruvian Studio Partners does not warrant that functions available on or through the service will be uninterrupted or error free, that defects will be corrected, or that the service or the server that makes it available are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
   11. Vitruvian Studio Partners is continually seeking to improve the Recorded Course Services. Vitruvian Studio Partners reserves the right, at its discretion, to make changes to any part of any Recorded Course Service provided that it does not materially reduce its content or functionality.

3. Live Streaming Class Access

1. 1. Access to any Live Streaming Class is available beginning on the scheduled class start date and after successful completion of payment.
   2. Access to any Live Streaming Class is granted solely to the individual who made the purchase. Transferring or sharing of login details with others is strictly prohibited and will result in immediate suspension of your account.
   3. Access to Live Streaming Class content expires one week after the last scheduled class session. Each week’s replay video is available for one week between class sessions.
   4. Vitruvian Studio Partners reserves the right to remove any student from any Live Streaming Class without refund should that student violate these Terms and Conditions.
   5. Vitruvian Studio Partners warrants that it has the right to provide the Live Streaming Class Service and will use all reasonable skill and care in making the Live Streaming Class Service available to you and in ensuring its availability. Because of the nature of the internet, errors and omissions do occur and Vitruvian Studio Partners does not give any other warranties in respect of the Live Streaming Class Service. 
   6. If Vitruvian Studio Partners has reason to believe that there is likely to be a breach of security or misuse of the website, we may require you to change your password or we may suspend your account.

Vitruvian Studio Partners reserves the right, at its discretion, to make changes to any part of any Live Streaming Class Service provided that it does not materially reduce its content or functionality.

4. Membership Community Access

1. 1. Membership community access is tied to an ongoing monthly membership fee. You will retain access to membership community content for as long as your membership and payment subscription remain active and in good standing.
   2. Membership fees are processed on the first day of each month.
   3. Membership Tiers:
      1. The “Basic” membership tier includes access to all content from the respective community, except private critique meetings with Vitruvian instructors. 
      2. The “Advanced” membership tier includes access to all content from the respective community, and 1 private critique meeting with Vitruvian instructors each month.
      3. The “Premium” membership tier includes access to all content from the respective community, and 2 private critique meetings with Vitruvian instructors each month.
   4. Access to any membership community (ie: the Studio Practice Community) is available on the first day of the month for which the student has registered, after successful completion of payment.
   5. Access to any membership community is granted solely to the individual who made the purchase. Transferring or sharing of login details with others is strictly prohibited and will result in immediate suspension of your account.
   6. Access to membership community content expires at the end of the month during which the student cancels their subscription.
   7. Critique appointments included in the “Advanced” and “Premium” membership tiers must be used in the month for which they’re paid. Any unused critique appointments are forfeit at the end of the month, and do not “roll over” to any subsequent month.
   8. Vitruvian Studio Partners reserves the right to remove any student from any membership community, without refund, should that student violate these Terms and Conditions.
   9. Vitruvian Studio Partners warrants that it has the right to provide the membership community Service and will use all reasonable skill and care in making the membership community Service available to you and in ensuring its availability. Because of the nature of the internet, errors and omissions do occur and Vitruvian Studio Partners does not give any other warranties in respect of the membership community Service. 
   10. If Vitruvian Studio Partners has reason to believe that there is likely to be a breach of security or misuse of the website, we may require you to change your password or we may suspend your account.
   11. Vitruvian Studio Partners reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts, or disrupts any of our services in any way.

Vitruvian Studio Partners does not warrant that functions available on or through the Service will be uninterrupted or error free, that defects will be corrected, or that the service or the server that makes it available are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
   14. Vitruvian Studio Partners is continually seeking to improve the membership community Services. Vitruvian Studio Partners reserves the right, at its discretion, to make changes to any part of any membership community Service provided that it does not materially reduce its content or functionality.

4. Live Class and Live Stream Recordings

1. 1. Recording by the end user of live streaming class sessions, or any other live streamed video offered as part of the Service,  is prohibited.
   2. Vitruvian Studio Partners retains recordings of each live streaming event, including live streaming class sessions. These recordings are the sole property of Vitruvian Studio Partners.
   3. Recordings of live streaming events will be made available to enrolled students on the following terms:
      1. Individual live streaming class sessions will be available to students enrolled in the respective class for one week following the original class date. The granting of access to recordings beyond that time frame is at the sole discretion of Vitruvian Studio Partners.
      2. Other live streaming video events, offered to students enrolled in a membership community at Vitruvian Fine Art Studio, will remain available to each student for the duration of their respective membership.
   4. Vitruvian Studio Partners reserves the right to re-sell live class recordings that include all original content from the class. This includes video and audio of the instructors’ teaching, and audio-only of any student questions asked during the live stream.

5. Cancellation and refunds for Live Streaming Classes

1. 1. Cancellations prior to the start date:
      Prior to the scheduled start date, you can cancel your registration for any Live Streaming Class for a full refund minus a 5% non-refundable processing fee.
      
   2. Cancellations after the start date:
      For Live Streaming Classes (one class session per week for 6 or 8 weeks), you can cancel your registration up to the start of the second class session for a 50% refund of the total tuition. This gives you 1 class session in the studio, plus nearly 7 days (165 hours) until the start of the next class session to notify us of your intent to cancel. Once the second class session has started, however, no refunds will be given under any circumstances.
      
   3. Your access to the Live Streaming Class Service may be terminated by written notice if you are in material breach of these terms and the breach is not remedied within the period of 14 days after written notice of the breach has been given to you. If we reasonably believe your breach of these terms affects our lawful operation of the Live Streaming Class Service or third party customers we may suspend your access to the Live Streaming Class Service at any time.

6. Cancellation and refunds for membership communities

1. 1. Membership communities at Vitruvian Fine Art Studio, including the Studio Practice Community, require a minimum enrollment equal to 2 whole months, and completed payments for those first two months.
   2. After the first two months, you may cancel your membership at your discretion.
   3. If you cancel your membership, your access to the membership community will remain active until the end of the calendar month in which your last successful payment was processed. Your access will expire at the beginning of the following month.
   4. All monthly payments for membership community access are final. No refunds of membership fees will be granted for any reason.

5. Reference Material

1. 1. As part of the Live Streaming Class and membership community content, Vitruvian Studio Partners may make reference images available to enrolled students for use during the class. Any unauthorized duplication, modification or distribution of said reference material is strictly prohibited.
   2. For Online Courses, Live Streaming Classes, membership community content that involves the use of nude models (ie: Figure Drawing), Vitruvian Studio Partners will require registered students to sign a usage agreement prohibiting the inappropriate use of reference materials. Any unauthorized use of such materials, including duplication, modification  or distribution, will result in immediate suspension of access to said class, and a permanent ban from enrollment in any future service provided by Vitruvian Studio Partners.

6. Posting of content 

1. 1. Some Online Studio Services allow you to post content to the vitruvianstudio.com website including asking questions about the course and taking part in discussions.
   2. All content which you provide or upload to our website shall be subject to the relevant provisions of our General Terms & Conditions.

7. Fair use policy 

1. 1. We operate a ‘fair use’ policy to protect the quality of our Online Studio Services. If we believe your use of a Online Studio Service is taking up excessive bandwidth or your use of a Online Studio Service is adversely affecting the provision of the service (or any part of it) to other users, or other users’ enjoyment of the service, we reserve the right to manage or regulate your usage of the Online Studio Service. This may include temporarily suspending your user account and/or access to the Online Studio Service.

8. No commercial use 

1. 1. All Online Studio Services are available for non-commercial use only. Vitruvian Studio Partners reserves the right to refuse orders from businesses that we consider are for commercial concerns. You may not re-sell or make available to any third party the Online Studio Services without the prior written consent of Vitruvian Studio Partners. 

9. International use 

1. 1. We make no promise that materials available on or through the Online Studio Service are appropriate or available for use in locations outside the United States of America, and accessing the Service from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Service from locations outside the United States of America, you do so on your own initiative and are responsible for compliance with local laws.

Vitruvian Fine Art Studio is committed to protecting your privacy. This Privacy Policy describes how we collect, use, and disclose data. This policy applies to your use of Vitruvian Fine Art Studio’s classes, workshops, live streaming events, online courses, lessons, tutorials, training materials, and other uses of the website located at vitruvianstudio.com (collectively, “the Service”).

Vitruvian Fine Art Studio is owned and operated by Vitruvian Studio Partners, a United States general partnership in the State of Illinois. We offer representational art instruction locally in our Chicago studio, and globally via online courses and workshops offered on our website at vitruvianstudio.com.

Vitruvian Fine Art Studio collects two kinds of information about you: (1) Personal Data; and (2) Non-Personal Data.

1. Personal Data

Personal Data is any information relating to an identified or identifiable natural person. Personal Data we may collect includes:

1. Identification and Contact Data: name, company name, address, contact details, username, or other demographic information;
2. Financial Information: credit card details, account details, payment information; This type data is collected via our payment processors APIs. No payment information is stored by Vitruvian Fine Art Studio or on vitruvianstudio.com
3. Browsing Information: IP address, cookie data
4. Personal Interests or Preferences: history of purchases on our site.

You may decline to provide Personal Data to Vitruvian Fine Art Studio. However, some of the Personal Data we ask you to provide is mandatory for use of the Services. If you decline to provide it, we may not be able to provide the Services to you.

1. Purchases

We collect information about you during the checkout process when you browse or purchase anything on our website.

• Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed

For example, we will store order information for 10 years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.

Vitruvian Fine Art Studio’s website administrators have access to the information you provide us, including the following:

• Order information like what was purchased, when it was purchased and where it should be sent, and

We accept payments through Stripe and PayPal. When processing payments, some of your data will be passed to Stripe or PayPal, including information required to process or support the payment, such as the purchase total and billing information.

2. Shipping

If you purchase a physical product from our website, you may be required to purchase shipping. In such instances, your physical address will be shared with our shipping provider, the United States Postal Service. For international shipments, USPS may then share this information with local postal services in the destination country.

3. Comments

If you leave a comment on our site we collect the data shown in the comments form, and also your IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here. After approval of your comment, your profile picture is visible to the public in the context of your comment.

4. Media

Images uploaded to the site may contain embedded location data (EXIF, GPS). Any visitor to the website can download and extract any location data from those images. If you wish not to share such information on the Service, you should avoid uploading images with that contain embedded location data. 

5. Contact forms

If you use our contact form, you’ll be asked to submit your name and email address along with your inquiry. This information is logged with your submission so we can respond. Your IP address is also recorded when you submit to our contact form. We use IP address information to block certain IP addresses that may spammed our contact form in the past.

6. Email subscription forms

We use a 3rd party email marketing service called ConvertKit to host and manage our mass communications and distribution list. If you subscribe to the list, to receive an incentive or to be kept informed about the Service, you are consenting to receive periodic marketing-related email communications. Subscribers must provide a first name, and email address to sign up. Our email service also records an IP address for each subscriber and any relevant context data (such as from which page on our site the subscription was initiated). 7. Cookies

Each merchant and third-party payment processor collects and shares your information according to its own privacy policy and terms of service. Vitruvian Fine Art Studio is not responsible for the actions of third-party processors or merchants, including how such entities treat your information. You are responsible for knowing and understanding their policies and terms.

7. HOW LONG WE RETAIN YOUR DATA

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register or enroll in the Service on our website, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information. We store this information for as long as the user’s account remains active and in good standing.

We retain customer purchase records for a period of 10 years from the purchase date. This includes name, address, email address, account username, items purchased and their relative cost, order total, and any customer notes provided at the time of checkout. We do not retain, or have any access to, customer payment details such as credit card numbers or account passwords.

8. WHAT RIGHTS YOU HAVE OVER YOUR DATA

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

All user data, including transaction data, is protected by the following means:

• Encryption: All data is transmitted over 256-bit SSL, the same protocol used by financial firms to ensure secure data transmission.
• Secure Storage: Once processed, all data are then uploaded to our secure servers. Your data is then accessible only by someone with access to your account, and certain Vitruvian Fine Art Studio staff members.

We employ commercially reasonable security measures to protect your information; however, no system is impenetrable. If you create an account on the Service, you are responsible for protecting the security of your account, its content, and all activities that occur under the account or in connection with the Services. 10. WHAT DATA BREACH PROCEDURES WE HAVE IN PLACE

In the event of a suspected data security breach we will notify you and any applicable regulator within 72 hours of our detection of the breach.

11. USERS UNDER 13 YEARS OF AGE

Our Services are not directed to and we do not knowingly collect Personal Data from children under the age of 13. If we become aware that a child under the age of 13 has provided us with Personal Data, we will take steps to remove such data. Opting out of Receiving Electronic Communications from us.

If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link or by notifying us at [email protected]. We may still send you important messages regarding administrative matters, updates, disputes, and customer service issues that are required to provide you with the Service.
